1. Introduction
These Warranty Terms (“Warranty”) govern the provision of repair services (“Services”) and replacement parts (“Parts”) by SEKI GADGETS to customers (“Customers”) for their devices (“Devices”) and accessories (“Accessories”, “Accessory”). By submitting a Device for repair or purchasing an Accessory, the Customer agrees to be bound by this Warranty.
In addition to this Warranty, certain Services or Accessories provided by SEKI GADGETS may be subject to supplemental terms and conditions. In the event of any conflict between this Warranty and the provisions of a supplemental agreement, the provisions of the supplemental agreement shall control with respect to the applicable Services or Accessories.
2. Definitions
- (a) References to “SEKI GADGETS”, “us”, “we”, and “our” refer to the warrantor under this Warranty.
- (b) References to “you”, “your”, “client”, “partner”, and “customer” refer to the purchaser of the Device, Accessory, and/or recipient of the Services.
- (c) References to “device” refer to the iPhone, iPad, phone, tablet, screen, logic board, motherboard, gaming console, accessory, and/or any other device repaired by SEKI GADGETS subject to this Warranty.
- (d) References to “accessory” refers to any product sold by SEKI GADGETS subject to this Warranty, including but not limited to cases, screen protectors, chargers, and cables.
- (e) References to “service ticket”, “ticket”, “repair”, and “service” refer to the document containing details of the repair(s) performed on the Device subject to this Warranty.
3. Warranty Scope and Limitations
3.1 Non-Transferable
This Warranty is non-transferable.
3.2 Warranty Period
The Warranty shall be in effect for the following periods:
3.2.1 Repairs
Phones: Lifetime warranty covering the part installed for defect or malfunction not caused by physical/liquid damage.
Tablets: Lifetime warranty covering the part installed for defect or malfunction not caused by physical/liquid damage.
Laptops: One (1) year warranty covering part installed for defect or malfunction not caused by physical/liquid damage.
Consoles: Lifetime warranty covering the part installed for defect or malfunction not caused by physical/liquid damage.
Other Devices (e.g., drones, iPods, remote controls): Thirty (30) days warranty covering the part installed for defect or malfunction not caused by physical/liquid damage.
3.2.2 Accessories
Non-Branded Accessories: Six (6) months from the date of purchase.
Branded Accessories (e.g., OtterBox, LifeProof, PureGear): One (1) year or limited lifetime warranty through the manufacturer.
3.2.3 Devices
Device Warranty: Six (6) months unless stated otherwise. The warranty is valid as long as the device has not been damaged (water, cracks, deep scratches etc.).
3.3 Coverage
3.3.1 Repairs
We warrant the installed part to be free from defects in materials, faults, and/or workmanship during the applicable Warranty Period. Warranties are processed via part exchanges. No refunds will be issued for warranty issues. Repairs or replacements shall not extend, restart, or roll over the warranty period. The Repair will be covered by the remaining time balance of the original Warranty.
- For Phones: Lifetime warranty on installed parts.
- For Tablets: Lifetime warranty on installed parts.
- For Laptops: One (1) year warranty on installed parts.
- For Consoles: Lifetime warranty on installed parts.
- For Other Devices (e.g., drones, iPods, remote controls): Thirty (30) days warranty on installed parts.
3.3.2 Accessories
We warrant the Accessory to be free from defects in materials during the applicable Warranty Period. Replacements shall not extend, restart, or roll over the warranty period.
3.3.3 Devices
We warrant the Device to be free from defects in materials, faulty parts, and/or workmanship during the applicable Warranty Period. We may repair the defect(s), replace the Device, or offer a full refund of the purchase price less any postage costs, at our discretion. Replacement parts may include aftermarket, remanufactured, and/or refurbished parts or components.
3.4 Exclusions
3.4.1 Devices
This Warranty does not cover:
- Devices that we were unable to test prior to repair;
- Defaced, modified, or removed serial numbers, IMEIs, or part serial numbers;
- Accidents, misuse, neglect, fire, water, lightning, acts of nature, unauthorised modifications, or failure to follow supplied instructions;
- Liquid or water damage;
- Repairs or attempted repairs by anyone other than SEKI GADGETS;
- Unauthorized software modifications resulting in damage;
- Loss of programs, data, or removable storage media;
- Software or data loss occurring during repair or replacement;
- Data recovery services;
- Transit damage;
- External causes such as power surges or failure;
- Normal wear and tear;
- Image burn damage;
- Unauthorised software, viruses, malware, spyware, or third-party software;
- Installation of unauthorised hardware, accessories, consumable parts, or components;
- Damage to display coating from incorrect cleaning;
- LCD/OLED/AMOLED or glass physical damage, including LCD-only damage;
- Removal, installation, and set-up service charges;
- Any other cause unrelated to the Device.
3.4.2 Products
This Warranty does not cover:
- Normal wear and tear;
- Damage caused by misuse, neglect, accidents, or unauthorized modifications;
- Damage caused by improper installation or removal;
- Any other cause unrelated to defects in materials and workmanship.
4. Warranty Claim Requirements
4.1 Devices
- Proof of Purchase: You must retain a copy of the Service Ticket or Sales Invoice. We may reject warranty claims without proof of purchase.
- Device Preparation: Prepare your Device for Service following our Device Service Preparation Guide and remove all personal information. We may refuse service or warranty processing if you fail to provide the passcode.
- Warranty Processing Fee: A $65.00 Warranty Processing Fee applies to all Warranty Claims.
- Your Data: We are not responsible for loss of user-generated personal data. The Device’s storage media may be deleted and reformatted during warranty service.
4.2 Accessories
- Proof of Purchase: You must retain a copy of the Sales Invoice. We may reject warranty claims without proof of purchase.
5. Requesting Warranty Service
To request warranty service, please follow these steps:
- Contact our support team by email or through our website to initiate a warranty claim.
- Provide your proof of purchase, such as the original Sales Invoice or Service Ticket, and any other relevant information requested by our support team.
- Follow the instructions provided by our support team regarding the return or repair process, which may include:
- Bringing the Device or Accessory to our store location;
- Mailing the Device or Accessory to our store location; or
- Arranging for a courier collection of the Device or Accessory.
- Pay any applicable Warranty Processing Fee, postage costs, or other fees as communicated by our customer support team.
Please note that failure to comply with these steps or provide the required information may result in delays or denial of your warranty claim.
6. Warranty Seals (For Devices)
Tampering with or removal of warranty seals applied by SEKI GADGETS may void this Warranty. Do not attempt to open the Device, as this may cause damage not covered under warranty.
7. Service Methods
We reserve the right to change how we provide warranty service and determine a Device’s eligibility for a particular service method.
8. Limitation of Liability
Our liability is limited to the cost of repair or replacement of the parts (for Devices) or the Accessory. We are not liable for any incidental, consequential, direct, indirect, or other damages, including but not limited to damages to other property, inconvenience, loss of use, time, profits, business opportunity, goodwill, or business relationships, even if advised of the possibility thereof.
9. Liquid Damage and Data Recovery (For Devices)
Any Device with liquid or water damage is not covered under this Warranty. Additionally, data recovery services are not covered under this Warranty.
10. Software Services (For Devices)
This Warranty does not apply to software services such as device restore, factory reset, virus removal, device setup, data export, recovery, or transfer.
11. Transit Damage
You must inspect goods upon receipt and report transit damage to us within five (5) days or warranty claims may be denied.
12. Faulty Item Ownership
Faulty items replaced under warranty become the property of SEKI GADGETS.
13. Additional Costs (For Devices)
In addition to the Warranty Processing Fee, we may seek reimbursement of costs incurred if, upon inspection, the Device is free of faulty parts/workmanship or the faults are unrelated to the Services performed, resulting in warranty claim denial.
14. Performance Determination
We reserve reasonable discretion to determine whether a Device, Accessory, or Service is performing to specifications.
15. Warranty Modification
We may update, change, or replace any part of this Warranty at any time. The most recent version shall be in effect. Customers are responsible for regularly reviewing the Warranty. Continued use of the Services or Products after any such changes constitutes the Customer’s acceptance of the revised Warranty.
16. Maximum Liability
Our aggregate liability for all warranty claims shall not exceed the original purchase price of the Device, Accessory, or Service, or at our option, the replacement cost with a similar Device or Accessory.
17. Severability
If any provision of this Warranty is held illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
18. Consumer Guarantees
Consumer Guarantee means any of the consumer guarantees contained in part 3-2 Division 1 of the Australian Consumer Law.
SEKI GADGETS liability in respect of a breach of a Consumer Guarantee or any express warranty provided by SEKI GADGETS in relation to the Services and Parts is limited to, to the extent permissible by law and at SEKI GADGETS’ option:
(a) in relation to the Services:
- the supply of the Services again; or
- the payment of the cost of having the Services supplied again; and
(b) in relation to Parts:
- the replacement of the Parts or the supply of equivalent Parts;
- the repair of the Parts;
- the payment of the cost of replacing the Parts or of acquiring equivalent Parts; or
- the payment of the cost of having the Parts repaired.
19. Manufacturer Warranties
UNDER NO CIRCUMSTANCES WILL SEKI GADGETS TAKE RESPONSIBILITY FOR MANUFACTURER WARRANTIES. Any manufacturer warranties are provided solely by the manufacturer and are subject to their terms and conditions. SEKI GADGETS does not assume any liability or obligation under manufacturer warranties.
20. Exclusion of Warranties
(a) To the maximum extent permitted by law, all other warranties whether implied or otherwise, or in specific warranties accompanying any Parts are excluded and SEKI GADGETS is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the Customer for:
- any increased costs or expenses;
- any loss of profit, revenue, business, contracts or anticipated savings;
- any loss or expense resulting from a claim by a third party; or
- any special, indirect or consequential loss or damage of any nature whatsoever.
21. Governing Law
This Warranty shall be governed by the laws of the Australian Capital Territory, Australia. The parties submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory for any disputes arising out of or in connection with this Warranty.
